if ASU were not a governmental instrumentality, and were merely a nonprofit enterprise, then the IRS would be all over it, for "unrelated business taxable income" issues, and perhaps, its tax exempt status, due to the numerous "non-education" (i.e., non charitable) related operations and endeavors which are actively being pursued.
I can only assume that the AG feels that his efforts are necessary, on behalf of the people of AZ.
ASU does not have an endowment comparable to UTexas, Harvard, etc., and with declining support from the AZ legislature, I think Crow's initiatives on the "e-education" front are brilliant, as a revenue enhancer.
On this specific issue, I fall on ASU's side - and by way of example, if someone were to gift/bequeath the State Farm land along Rio Salado, or the Mill & University parcel to the ASU Foundation, then no one would think twice about the long term ground leasing by ASU of the parcels.
However, as a collateral issue, the taxpayers are getting the shaft, because the "government property lease excise taxes" which are paid by the owners of the improvements on the ASU parcels, are far less than what the "normal" ad valorem property taxes would have been if a private developer/investor were the owner.
I think at the end of the day, this in equity is the essence of what Brnovich is pursuing.
