The applicable regs do allow for some non-discriminatory reasons for a disparity in dollars spent on women and mens. For example, more money being spent on football field maintenance, crowd control, etc.
Unfortunately, they don't allow for a disparity related to scholarships. This is the true failing of Title IX - but for revenue generated from football, there wouldn't be money to run the Athletic Department.
The rebuttal, however, is that football is taking away from equality between men and women – at which point these people point to all of the successfully run Division II programs (meaning in the black, rather than winning programs) that don't have football teams, but have gender equality in athletics.
